A huge policy change is taking place in the United States. The Department of Homeland Security (DHS) has said that migrant workers will not automatically receive extensions for their Employment Authorization Documents (EADs) anymore if they apply for renewals on or after October 30, 2025.
This is a big change because non-citizens were previously allowed to work legally during the processing of their renewal applications by taking advantage of the grace period. The situation is such that the workers will now have to wait for the official approval before they are allowed to start again — a problem that can involve thousands of professionals, with the majority being from India.
What’s Changing
Up until now, the eligible migrants were able to count on automatic extensions of their work permits for a maximum of 180 days as their applications were being processed. The new regulation will do away with that completely. Even timely renewals might put applicants in a position of having no choice but to stop working until their renewals have been granted, as they will not have a valid EAD.
The DHS maintains that the new rule will bring simplification to the process and will eliminate inconsistencies, but the opposers say that it will cause economic disruption to the foreign workers who are being honest and lawful while contributing heavily to the U. S. economy.
Who Will Be Most Affected
The new policy covers a wide range of visas — including children of H-1B workers, applicants for Green Cards, and people with temporary protected or humanitarian statuses. For Indian professionals and their better halves, especially those depending on work permits, this new policy can cause job interruptions or loss of income.
Plan Ahead and Stay Prepared
There will now be a need for the applicants to plan renewals at least a few months ahead of expiration dates and keep up-to-date documentation ready to prevent work gaps.
