Canada Tightens Work-Permit Rules: What Changes for Foreign Workers

The Canadian government has made a big change to its Temporary Foreign Worker Program (TFWP) recently. The most important alteration: the previous “wage assessment” criterion has been eliminated. TFWP applications for work permits can now only depend on a successful Labour Market Impact Assessment (LMIA).

LMIA — particularly its significance

A Labour Market Impact Assessment (LMIA) is an official acceptance granted to an employer in Canada, which assures that the position has no proper Canadian candidate available. And so, the employer can bring in a foreign worker. LMIA will become the employers’ mainstay, the first condition, for their foreign-worker work-permit applications.

The Most Notable Changes

  • The regulations modified (which took effect in late 2024) have left Canada with pretty much tight immigration rules for foreign labor, particularly for the employment of “low-wage” workers.
  • In most urban areas with higher unemployment rates, low-wage-stream LMIA applications are being refused or at least blocked.
  • The number of foreign workers that can be employed under the Temporary Foreign Worker Program low-wage stream is very limited for employers, often it is not more than 10% of the total workforce.
  • In a series of recent changes, the life of LMIA approvals has been decreased, and job eligibility has become very stringent.

What This Means for Foreign Workers and Applicants

The whole thing has become a long process with a lot of scrutiny — the job-seekers will have to be sure that the employer possesses a valid LMIA already. Access to low-wage jobs through TFWP in many cities has become tough, especially in regions of high unemployment.
